Napanee franchisees Morgan and Mishelle Rayer secured a legal victory when the Ontario Divisional Court granted them permission to appeal a previous ruling that denied their request for injunctive relief.
Engaged in a legal battle with Recipe Unlimited since December 2023 over their joint Harvey’s and Swiss Chalet restaurant.
The Rayers, despite being locked out, now have the authority to operate during their ongoing dispute with both their landlords and Recipe Unlimited, the parent company of Harvey’s-Swiss Chalet.
Alleging that assets have been removed from the restaurant and facing what they deem as unreasonable reopening terms, the Rayers are awaiting cooperation from Recipe Unlimited.
